Privacy Policy

Moffee (the "Site") is operated by Ujjwal Arya, Sales Representative with Royal LePage Signature Realty, Brokerage (Independently Owned and Operated), 30 Eglinton Ave. West, Suite 200, Mississauga, ON L5R 3E7. The brokerage is the controller of personal information collected through the Site for the purposes of Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and Ontario's Trust in Real Estate Services Act, 2002 (TRESA).

We collect personal information in three ways:

• Information you provide. Your name, email address, phone number, postal code, household details (where you choose to share them), saved searches, favourited listings, notes you record on a property, showing requests, messages you send us, and any document or attachment you upload.
• Information about your use of the Site. Pages you visit, listings you view, time and duration of visits, approximate location based on IP address, browser and device information, and referral source. This is collected automatically through cookies and similar technologies.
• Information from third parties. Authentication and identity information from our login provider (Supabase Auth), and MLS® listing context from TRREB's VOW data feed.

We use personal information only for the purposes set out below:

• to deliver the Site and authenticate your account;
• to fulfil your requests — for example, arranging a showing, sending you a market analysis, or answering a question about a listing;
• to comply with our obligations as a real estate brokerage under TRESA, the TRREB VOW Policy, the PropTx VOW Datafeed Agreement, FINTRAC, and other applicable laws;
• to send you marketing or service communications you have consented to, consistent with our Terms of Use and Canada's Anti-Spam Legislation (CASL);
• to detect and prevent fraud, scraping, account abuse, and security incidents;
• to improve the Site through aggregated, de-identified analytics.

We will not use your personal information for a purpose that is materially different from the one for which it was collected without first obtaining your consent.

When you create an account or submit a contact, showing, or information request through the Site, you provide express consent for Ujjwal Arya and Royal LePage Signature Realty, Brokerage to contact you by email, telephone, and text message in connection with your real estate enquiry. You can withdraw consent to receive marketing communications at any time by clicking the unsubscribe link in any email or by writing to uj@moffee.ca. Withdrawing marketing consent does not end an active client or customer relationship; we may still contact you about transactions in progress and obligations we owe you under TRESA.

We share personal information only with parties who help us operate the Site or who we are legally required to share it with:

• Royal LePage Signature Realty, Brokerage — your registered information is held in the brokerage's books and records as required by TRESA and TRREB.
• Service providers who process information on our behalf under written confidentiality terms — including our hosting provider (Vercel), backend host (Render), database (Supabase Postgres), cache (Upstash Redis), email delivery, analytics, and PDF generation. These providers operate primarily in Canada and the United States.
• PropTx, TRREB, and CREA — as a condition of accessing MLS® listing data through this Site, PropTx is authorized to receive your personal information (including your name, contact details, and your activity on this Site) for audit, compliance verification, and enforcement purposes under the PropTx VOW Datafeed Agreement. TRREB and CREA may also receive information in connection with audits of our use of the VOW data feed. By registering on this Site you consent to this sharing (see also Section 9(ix) of our Terms of Use).
• Other parties to a transaction, where you have asked us to act on your behalf — for example, a co-operating brokerage, a lawyer, an inspector, a lender, or a stager — and only with information relevant to the transaction.
• Government authorities, where required by law, including FINTRAC reports under the Proceeds of Crime (Money Laundering) and Terrorist Financing Act.

We do not sell, rent, or trade personal information.

Some of our service providers store or process information in the United States. Where this happens, we use providers that contractually commit to privacy and security standards consistent with PIPEDA. Information stored outside Canada may be subject to lawful access requests by foreign authorities.

We keep account and transaction information for as long as you have an account with us, and afterwards for the retention periods required of a real estate brokerage by TRESA, TRREB, and FINTRAC — currently a minimum of six years from the end of the fiscal year in which the record was created. Marketing preference records are kept for the period required by CASL. Server logs and analytics are retained for shorter, rolling periods.

We use reasonable administrative, technical, and physical safeguards to protect personal information, including encryption in transit, encrypted storage at our database providers, scoped access controls, and audit logging on sensitive endpoints. No system is perfectly secure; if we become aware of a breach that creates a real risk of significant harm, we will notify you and the Office of the Privacy Commissioner of Canada as required by PIPEDA.

The Site uses cookies that are strictly necessary for authentication and session management, and additional cookies that help us understand aggregate usage. Where consent is required by law, we will request it before setting non-essential cookies. You can clear or block cookies in your browser settings, though some features (notably login) will not work without them.

You have the right, on request, to:

• access the personal information we hold about you;
• have inaccurate information corrected;
• ask us to delete information that we are not required to keep by law or by our brokerage record-retention obligations;
• withdraw consent for future marketing communications;
• receive an explanation of how a particular piece of information is being used.

We will respond within thirty (30) days. To exercise any of these rights, email uj@moffee.ca with the subject line "Privacy request."

The Site is not intended for, and we do not knowingly collect information from, children under the age of eighteen. If you believe a child has provided us with personal information, please contact us so we can delete it.

We may update this Privacy Policy from time to time. The "Effective" date at the top of the page reflects the most recent change. Material changes will be brought to your attention through the Site or by email.
