Terms of Use

Moffee (the "Site") is operated by Ujjwal Arya, Sales Representative with Royal LePage Signature Realty, Brokerage (Independently Owned and Operated), located at 30 Eglinton Ave. West, Suite 200, Mississauga, ON L5R 3E7. References to "we," "us," and "our" mean Ujjwal Arya and Royal LePage Signature Realty, Brokerage, jointly. References to "you" mean any person who accesses or registers on the Site.

Listing content on the Site is provided under the Toronto Regional Real Estate Board (TRREB) Virtual Office Website Policy and the related VOW Agreement that we have signed with TRREB. TRREB and the Canadian Real Estate Association (CREA) own the MLS® database, MLS® data and related trademarks. We display this data under licence; you receive only a personal, non-commercial right to view it. You may not copy, scrape, redistribute, frame, or build a derivative product from the listings, in whole or in part.

To view information that TRREB classifies as VOW-restricted (for example, sold and historical sale information, days on market, and certain remarks) you must register on the Site, accept these Terms, and confirm a bona fide interest in the purchase, sale, or lease of real estate of the type being offered through the Site. Registrations that we believe are not bona fide may be suspended without notice.

This is the most important section. Please read it in full.

Under Ontario's Trust in Real Estate Services Act, 2002 (TRESA) and the TRREB VOW Policy, the moment a registered real estate professional begins to provide value to a consumer — by analyzing a property, arranging a showing, preparing a comparative market summary, advising on price or offer strategy, or otherwise helping the consumer make a real estate decision — a working relationship is formed.

Accordingly, by registering on the Site, requesting a showing, requesting additional information about a property, requesting a price opinion or market analysis, asking us to submit an offer, or otherwise engaging with us through the Site, you acknowledge and agree that:

• You are entering into a customer or client working relationship with Ujjwal Arya and Royal LePage Signature Realty, Brokerage in respect of the services you have asked us to provide;
• You consent to receive the RECO Information Guide and, where applicable, the RECO Information and Disclosure to Self-Represented Party, and to sign a written representation agreement (Buyer Representation Agreement, Buyer Customer Service Agreement, or equivalent) before we provide any services that require one under Ontario law;
• You confirm that you are not currently a party to a written representation agreement with another REALTOR® or brokerage for the same purpose. If you are already represented, you must work with your existing REALTOR® and you must not request services from us. If you are unsure, contact your existing REALTOR® before submitting any showing or information request through the Site.

Nothing in this section creates a representation agreement on its own. Where Ontario law requires representation in writing, the working relationship will be confirmed in a written agreement signed by both parties. Until that written agreement is signed, you may be treated as a self-represented party and we may owe you a more limited duty under TRESA. We will explain the difference before we begin work.

By creating an account, requesting a showing, requesting more information about a property, or otherwise submitting a contact form, you expressly consent to be contacted by Ujjwal Arya and Royal LePage Signature Realty, Brokerage by email, telephone, or text message, including by automated means, at the contact information you provide, for the purpose of responding to your request and providing ongoing real estate services that we reasonably believe are relevant to you.

This is express consent for the purposes of Canada's Anti-Spam Legislation (CASL). You may withdraw consent to receive commercial electronic messages at any time by clicking the unsubscribe link in any of our emails or by emailing uj@moffee.ca. Withdrawing consent will end marketing communications but does not end an existing client or customer relationship.

You agree to provide accurate, current, and complete information when you register and to keep that information up to date. You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account. We may suspend or terminate access if we have reason to believe registration information is false, duplicate, or used to circumvent the VOW Policy.

Listing information is sourced from TRREB's data feed and refreshes on a scheduled basis. There may be a lag between a status change in TRREB and what appears on the Site. We make no warranty that the information is current, complete, or error-free, and you should verify any listing detail with us before making a decision in reliance on it. Estimated values, score cards, and analytics generated by the Site are informational only and are not appraisals.

You agree not to:

• scrape, crawl, or systematically extract data from the Site, or use any automated means to access it other than a generally available web browser;
• copy, redistribute, sell, sublicense, or commercially exploit any listing content;
• register on behalf of another person without their authorization, or create accounts to evade VOW restrictions;
• upload content that is unlawful, infringing, defamatory, or that identifies a third party without their consent;
• attempt to interfere with, probe, or reverse-engineer the Site or its underlying services.

The MLS® mark, the REALTOR® mark, and the trademarks of TRREB, CREA, and Royal LePage are the property of their respective owners. All other content on the Site, including the Moffee brand, layout, copy, and software, is owned by us or our licensors and is protected by Canadian and international copyright. You receive a personal, revocable, non-transferable licence to use the Site for the purposes set out in these Terms.

Listing data on this Site is delivered through the PropTx VOW Datafeed. By registering and accessing listings, you agree to the following terms required by PropTx as a condition of the VOW data licence (PropTx VOW Best Practices, Appendix B):

1. You acknowledge that a lawful broker-consumer relationship exists between you and Royal LePage Signature Realty, Brokerage, and that access to VOW data is provided in the context of that relationship.
2. All MLS® information made available through this Site is for your personal, non-commercial use only. You may not use listing data for any commercial purpose whatsoever.
3. You confirm that you have a bona fide interest in the purchase, sale, or lease of real estate of the type being offered through this Site.
4. You will not copy, redistribute, retransmit, or otherwise disseminate any listing information obtained through the Site, in whole or in part, for any purpose.
5. You acknowledge that PropTx, TRREB, and CREA hold copyright in the MLS® database and all MLS® information. No interest in that copyright is transferred to you by your access to this Site.
6. You will not scrape, data-mine, collect, store, or manipulate any listing information obtained through the Site, or use it to create or contribute to any database, compilation, directory, or other product or service.
7. Your mouse click accepting these Terms constitutes a sufficient act of agreement. No financial obligation arises solely from your acceptance of these Terms or your access to listing information on this Site.
8. These Terms of Use authorize PropTx and other TRREB Members to access this VOW for the purpose of verifying compliance with VOW Policy obligations.
9. By accepting these Terms, you consent — consistent with our Privacy Policy — to PropTx receiving and using your personal information (including your name, contact details, and activity on this Site) for audit, compliance, and enforcement purposes under the PropTx VOW Datafeed Agreement and applicable law.

To the fullest extent permitted by law, the Site and its content are provided on an "as is" and "as available" basis. We are not liable for indirect, incidental, special, or consequential damages arising from your use of the Site, including any decision made in reliance on listing data or analytics displayed here. Nothing in these Terms limits any liability that cannot be excluded under applicable law, including liability for fraud or for the duties owed by a registered REALTOR® under TRESA.

We may suspend or terminate your access at any time for breach of these Terms, breach of the VOW Policy, or at the request of TRREB, PropTx, or CREA. You may close your account at any time by contacting us. Sections that by their nature should survive termination — including sections 3, 4, 6, 8, 9, and 12 — will continue to apply.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict of laws principles. The courts of Ontario have exclusive jurisdiction over any dispute arising from these Terms or your use of the Site.

We may update these Terms from time to time. The "Effective" date at the top reflects the most recent change. Material changes will be brought to your attention through the Site or by email to the address on your account. Your continued use of the Site after the effective date of an update means you accept the updated Terms.
